Order

Reasons
- Both parties attended the hearing. The landlord attended in person. The tenant attended briefly by telephone.
- Just prior to the hearing the tenant advised that she has been adjudged as a bankrupt. She has provided a copy of a page of the Insolvency Register which records that the tenant was declared bankrupt on 24 October 2025.
- The application before the Tribunal is for rent arrears and vacated costs following the tenancy which ended in September 2025.
- As the tenant is a bankrupt a money order cannot be made against her and instead the landlord would need to make enquires with the Official Assignee.
- The Tribunal can release the bond to the landlord where appropriate.
- I am satisfied that the tenancy ended with rent arrears totalling $7,678.57. As the Bond Centre holds a bond of $5,000.00 that is released to the landlord toward the arrears owed.
- As the Tribunal is unable to make any further money order, I have not considered the remainder of the landlord’s claim.
- Both parties seek suppression of their name. The landlord is entitled to a suppression order as the successful party.
- The tenant seeks suppression as she is a protected person under a Final Protection Order granted in the Family Court. The Act 1 provides that the Tribunal may order that the name of a party not be published having regard to the interests of the parties and the public interest. In the circumstances, I grant suppression of the tenant’s name to protect their safety and privacy.
