Reasons

The hearing was conducted by phone. Mr Olds and Ms Wyatt attended on behalf of the landlord (OCHT). No attempt was made to phone the tenant because he has been remanded in prison as the result of an alleged assault which is the subject of the application for termination.
I am satisfied that the notice of hearing has been emailed to Corrections. Mr Olds advised that he has also emailed all documents to Corrections for the attention of the tenant and told them that the hearing was to take place at
30am this morning.
No application or correspondence has been received from the tenant requesting to attend the hearing. The hearing therefore proceeded without him. 1 Reissued – replaces blank order issued in error.
The landlord has applied for termination of the tenancy under section 55(1)(c)(v) of the Residential Tenancies Act 1986 (the Act). This says that the Tribunal must terminate where the landlord applies for termination on the grounds that the tenant has assaulted or threatened to assault any neighbour.
The onus of proof is on the landlord, as the applicant. The standard of proof is on the balance of probabilities. I need to be satisfied that the allegations are more likely than not to be true.
The tenant lives at 21 Concord Place.
The landlord called two witnesses who confirmed the contents of their signed statements.
[Mr R] lives in the OCHT complex at [the complex]. Every day he visits his neighbour, [Mrs E], who also lives in another unit at [the complex]. On 16 October 2025, [Mr R] noticed some dog excrement on Mrs E’s doormat. He said that Wayne Purton lives directly opposite and had a small dog living with him. He called out to Wayne to come and remove the dog excrement and to remove some items that were on the communal path and grass outside.
[Mr R] said that Wayne came out and started charging towards [Mr R]. As [Mr R] tried to close the door, Wayne forced the door open and punched [Mr R] “a couple of times.”
On 19 October 2025, as [Mr R] was approaching [Mrs E]’s unit, Wayne called at him from inside his place that he was going to get a golf club and hit him over the head for allegedly kicking Wayne’s dog. While [Mrs E] and [Mr R] were having a cup of tea, Wayne came to the door with a golf club. They did not let him in, but he went to the back door and let himself in. [Mr R] said that Wayne then hit [Mr R] over the head twice with the golf club and again on the arm.
At hospital [Mr R] received staples to the wound on his head. Photos of his head and the arm wound were provided.
The ambulance and police were called. Wayne was arrested and remanded in custody. [Mr R] was told that Wayne has been charged with aggravated burglary and assault with a weapon.
[Mrs E] also gave a statement. She said that on 19 October, Wayne knocked at her front door. She didn’t open it because she was terrified. She crouched down in her chair while Wayne was abusing [Mr R]. Then Wayne came through the back door and charged into the lounge. He swung the golf club. She heard the club hit something, but she did not know what. She described [Mr R] and Wayne struggling with each other on the floor and on the chair she was hiding behind. A curtain was ripped and a painting was knocked off the wall. [Mr R] called for her to ring the Police, but the phone was no in reach.
Wayne left and she noticed blood on her dressing gown sleeve and on the mat on the floor. She said it was from [Mr R]’s head.
Mr Olds said that the Police have advised him that Wayne has been charged with aggravated burglary and wounding with intent to cause grievous bodily harm. Wayne is next due to appear in court for a bail hearing on 12 November 2025.
On the evidence before me, I am satisfied that it is more likely than not that Wayne Purton has assaulted [Mr R], who is a neighbour. Accordingly, the grounds for termination under section 55(1)(c)(v) have been established and I must terminate the tenancy at 21 Concord Place, Christchurch.
Because Otautahi Community Housing Trust has wholly succeeded with the claim I must reimburse the filing fee.
