Order

Reasons
- The landlord attended the hearing which was held by teleconference. The tenant did not attend despite multiple calls to his contact number provided in the application. I am satisfied that proper service of the hearing notice has been completed and considered it reasonable to proceed with the hearing in the tenant’s absence.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears, compensation for cleaning costs, refund of the bond and reimbursement of the filing fee.
Should the tenancy be terminated?
- Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
- Rent is at least 21 days in arrears at the hearing date. The tenancy is terminated.
How much does the tenant owe?
- The landlord provided rent records which prove the rent arrears owing.
- I am also satisfied on the evidence provided by the landlord that the tenant failed in his duty to keep the premises reasonably clean and tidy during the tenancy. This is supported by an inspection report, photographs and invoice. I find the tenant liable for cleaning costs. Filing fee and suppression order
- As the landlord has wholly succeeded with the claim, I must order the tenant to reimburse the filing fee and grant suppression of the landlord’s name and identifying details.
