Background
- This is the second application brought by [The landlord/s] seeking termination of the tenancy for rent arrears.
- On 21 October 2025, the Tribunal made an order: a. Terminating the tenancy on 5 December 2025. b. Awarding the landlord rent arrears of $1,114.10. c. Awarding the landlord the filing fee of $28.00. d. Releasing $1,142.10 from the bond to the landlord.
- The landlord filed this second application on 24 October 2025. The hearing took place on 19 November 2025. [The landlord’s representative] (representing the landlord) attended the hearing by video. Mr Grafton and Ms Edwards attended by phone. Rent arrears, termination
- [The landlord’s representative] said that they agreed to termination on 5 December in the previous proceedings because the tenants said they would continue to pay rent, but they did not.
- When [The landlord’s representative] filed this application there were rent arrears of $657.90. At the date of hearing there are rent arrears of $1,715.76. This figure takes into account the payments that the tenants have made and also the bond that was released to the landlord pursuant to the previous order.
- There are grounds for immediate termination of the tenancy due to the amount of arrears. 1
- At the hearing, Mr Grafton and Ms Edwards said that they would pay $1,100.00 today, 19 November 2025.
- [The landlord’s representative] agreed that the 5 December date for termination could stand if the tenants made this payment.
- I have made a conditional termination order recording the terms of this agreement.
- I have made an order by declaration about the amount of arrears as at today. I have not made an order for payment because the amount of arrears will change after the tenants pay $1,100.00 today and it will almost certainly change again before the end of the tenancy. I encourage the tenants to try to clear all of the arrears before the end of the tenancy if possible.
