This tenancy commenced on 5 July 2024. The applicant has applied to terminate the tenancy under Section 55 of the Residential Tenancies Act (RTA) on the grounds that the tenant has made threats toward neighbouring occupants and has caused, and continues to cause, substantial damage to the property. The applicant has provided photographic evidence and screenshots from other tenants to substantiate the grounds on which they are seeking termination.

The evidence provided, including photographs of several interior walls on which the respondent has written messages, indicates a significant level of mental distress and incoherent behaviour.

The landlord has advised that they have contacted support services and the police in an effort to obtain assistance for the respondent; however, they were informed that these services are unable to intervene or provide support without the respondent’s consent.

Should the tenancy be terminated?

Section 55(1)(b) provides that the Tribunal shall make an order terminating the tenancy if the tenant has caused, or permitted any other person to cause, substantial damage to the premises. The applicant has provided multiple photographs showing that the tenant has written extensively on several interior and exterior walls, has broken a glass panel, and that this behaviour and resulting damage is ongoing. It is on this ground, primarily, that I am terminating the tenancy.

There is a broader context to this matter. The tenant’s behaviours, while clearly appearing to be triggered by significant mental distress, have nevertheless caused severe disturbance to neighbouring occupants and have infringed upon their quiet enjoyment of their properties.

This constitutes a breach of the Residential Tenancies Act as well as a breach of the tenancy agreement. The scale and nature of these issues, as demonstrated in the evidence before me, are not capable of remedy.

Had I not terminated this tenancy under Section 55, I would have done so under Section 56(1)(c) on the basis that the breach is incapable of being remedied. H Ben Fayed 14 November 2025
