Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.
- Pisila Tia owes [The landlord/s] $3,230.14 (“the debt”), being rent arrears of $3202.14 for the period ending Monday 24 November 2025 plus the Tribunal application fee of $28.00.
- Pisila Tia must pay current rent and the debt as follows: a. By four weekly payments of $150.00 commencing on Tuesday 25 November 2025 and continuing every Tuesday until Tuesday 16 December 2025. These payments are in addition to normal weekly rent of $535.00 making the total to be paid for the next four weeks, $685.00. b. By one payment of $2,630.14 (the balance of the debt) on or before Tuesday 16 December 2025.
- The weekly payments will be allocated first to rent and then to the debt.
- If Pisila Tia fails to pay rent and the debt as set out in clause 3 above within 2 working days of the due dates: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- Both parties attended the hearing. [Mr H] represented the landlord.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order: section 55(1)(a) and (1A) of the Residential Tenancies Act 1986 (the Act).
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach: section 64(4)(b) of the Act. Suppression
- The landlord applied in their application for a suppression order. The landlord has been mostly successful in their claim and is therefore entitled to an order suppression their names and identifying details: section 95A of the Act.
