The person named as tenant probably does not know about this hearing. Usually, a hearing will not go ahead if one party does not know about it. In this case, I have dismissed the landlord’s application so there is no disadvantage to the named tenant. 1 The property manager sent an email to the address during the hearing and told me he received an automated message saying the email could not be sent.

The landlord has applied for payment of rent owing up to 11 March 2025 and refund of the bond.

An order was made by the Tribunal on 4 March 2025 relating to a tenancy at this address. That order terminated a tenancy and awarded rent owing up to 7 March 2025 but names a different tenant (“M”).

The previous order [2025] NZTT 5118968 and a written ‘Variation to the Residential Tenancy Agreement’ signed by [The respondent/s] satisfy me that she assigned her tenancy to M on 13 December 2023.

This application is dismissed, because:- a. [The respondent/s] was not the tenant during the dates the landlord claims rent for; and b. The landlord already has an order it can enforce against M, who was the tenant, for rent owing to 7 March 2025.

The landlord says it has a problem because the bond for this address is still held in the name of [The respondent/s] and not in M’s name.

I cannot refund the bond to the landlord. This is because the previous order decided that there was insufficient evidence to show that [The respondent/s] had agreed to transfer the bond to M to cover his tenancy. I cannot change a previous decision of the Tribunal unless there is some new evidence – which there is not.

The application has been dismissed so I suppress the name of the tenant and do not award the filing fee.
