The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The lawns and gardens were not left in a reasonably tidy condition.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission 2 .

The following damage was caused during the tenancy. The kitchen vinyl was significantly damaged and had to be replaced. The hallway walls were damaged and had to be repaired and redecorated.

I have depreciated the claim for the kitchen vinyl replacement by 20% to take account of its age and condition at the start of the tenancy and the fact that the tenancy lasted more than 6 years.

I have dismissed the claim for the remediation of methamphetamine contamination. Without a baseline reading from the start of the tenancy the Tribunal cannot be satisfied on the balance of probabilities that the tenant 1 See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA) 2 See sections 40(2)(a), 41 and 49B RTA caused the contamination or allowed it. All the readings were very low save for the one in the hallway.

As the application is successful, I have reimbursed the landlord the filing fee.
