- The Bond Centre is to pay the bond of $218.00 (3440576-005) to Kāinga Ora– Homes And Communities immediately.
- Tupai Kaita Kolo must pay Kāinga Ora–Homes And Communities $1,998.00 immediately, calculated as shown in the table below:
Reasons
- The landlord attended the hearing. The tenant did not.
- I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Should the tenancy be terminated?
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
What rent is owing?
- Section 138(1)(a) of the District Court Act 2016, states that the landlord cannot enforce this eviction order for 48 hours and is unlikely to be able to take possession of the premise until Monday 12 January 2026. This gives the tenant time to move any belongings out of the premise that the tenant wants to retain. The tenant will need to have all personal belongings out of the premise, the premise reasonably clean and tidy and the keys returned to the property manager by 9am on Monday 12 January 2026.
- The landlord provided rent records which prove the amount owing to 11:59pm on Sunday 11 January 2026.
