The tenancy is a fixed-term tenancy for the period 16 March 2024 to 15 March 2025. Ms Maslin was one of the three tenants named on the tenancy agreement.
Ms Maslin subsequently vacated the premises. However, as a tenant under the fixed-term tenancy agreement, she remained jointly and severally liable for the rent until the tenancy lawfully ended or she was released from her obligations.
Ms Maslin’s application was based on her financial circumstances and her inability to afford rent for two properties. Submissions
Prior to the hearing, Ms Maslin advised the Tribunal that a replacement tenant was expected to rent her former room. On that basis, she indicated that she would be willing to withdraw the application.
Ms Man also confirmed that the two remaining tenants had found a new tenant to take over the room in early February 2026.
On that basis, Ms Maslin’s circumstances had changed such that the grounds for the severe hardship application no longer applied. Analysis
Section 66 of the Act allows the Tribunal to grant relief from a fixed-term tenancy where continuation would cause severe hardship to the applicant that is greater than the hardship that would be suffered by the other party.
In this case, given the change in circumstances and Ms Maslin’s indication that the application would be withdrawn, there is no longer a live issue requiring determination under section 66.
It is therefore not appropriate for the Tribunal to consider the merits of the application.
Accordingly, the application is dismissed.
