Reasons
- Both parties attended the hearing via teleconference.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 (“RTA”).
- The landlord provided rent and water arrears records which prove the amount owing at the end of the tenancy.
- The amount of rent owing to 17/02/2026 is $7,240.00. The amount of water rates is arrears owing is $25.08.
- I order the tenant to pay the amount to the landlord.
- The landlord confirmed that she had received $980.00 as bond but that it had not been lodged with the Bond Centre. That is an unlawful act under the RTA.
- That amount will be deducted from the final amount payable by the tenant to the landlord.
- Because the landlord has wholly succeeded with the claim, the tenant must reimburse the filing fee.
