Order

Reasons
- The landlord attended the hearing via teleconference. The tenant did not.
- The landlord has applied for compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
- The tenancy was from 23 October 2018 until 30 October 2025.
- The landlord applied for compensation for the exit cleaning costs, curtain replacement costs, repair costs for a broken window frame, replacement cost for a missing blind and reglazing costs for the front glass.
- The landlord provided photos from the beginning and end of the tenancy to prove that the premises was not left reasonably clean and tidy at the end of the tenancy and that the damages occurred during the tenancy. I find that the damage was more than fair wear and tear.
- In considering replacement costs, the Tribunal must take into account depreciation. Having taken into account the age and condition of the curtains and blinds at the start of the tenancy and their likely useful lifespan, I do not grant the costs for replacing the curtains but grant a reduced amount to replace the missing blinds.
- I order the tenant to pay the landlord $945.00 for exit cleaning, $80.00 for broken window frame, $20.00 for missing kitchen blinds, and $327.00 to reglaze the front glass. These are exclusive of GST, therefore, the tenant must also pay the GST of $205.80.
- Further to this, as the landlord has substantially succeeded with the claim, the tenant must reimburse the landlord’s filing fee.
- The bond held will be paid to the landlord to offset the amount payable by the tenant.
