Reasons
- Both parties attended the hearing. Ms Speers represented the landlord.
- The tenant fixed a baby gate to two panels in the premises during the tenancy. The gate was removed at the end of the tenancy (the tenancy ended on 23 October 2025) leaving four small (2mm) holes in the panels and the landlord claims the sum of $522.78 being the costs (based on quotes) to replace the panels.
- Mr Eyles disputes the cost claimed. He said that the holes could have been filled and there was no need to replace the entire panels. He also claims that the panels were not replaced or the holes repaired before the house was sold by the landlord. He said that the premises were under a contract for sale on 27 November 2025 and when he visited the premises at an open home on 29 November, the holes had not been repaired. Ms Speers said that she understood from the landlords that the work had been done before the premises were sold but she could not confirm with any certainty that they had been repaired. She also said that the landlords did not provide her with any invoice(s) or other evidence to support what work was completed and at what cost.
- I am not satisfied that the landlords have provided sufficient evidence to establish that it is more likely than not that any work to repair the holes was completed before the premises were sold. I therefore find that the landlords have not established that they have suffered any loss as a result of the damage and their application is dismissed.
