- The tenancy of Gina Toamau at 677 Ngunguru Ford Road, Kiripaka, Whangarei 0173 is terminated, and possession is granted to Ella Grama and Christopher Forsyth, immediately.
- The hearing is adjourned.
Reasons
- The landlord has applied for termination of the tenancy for abandonment through the expedited process under section 91AA of the Residential Tenancies Act 1986.
Are there grounds for an expedited application?
- I am satisfied that the two requirements for the expedited process are met: a. The tenant does not wish to contest the abandonment application; and b. The information provided by the landlord with the application is sufficient to enable the Tribunal to determine it properly without a hearing (either on the basis of that information alone or with only minor clarifications).
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. (See section 61 Residential Tenancies Act 1986.) A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 01 December 2025, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. This was the date that the landlord carried out an inspection of the premises. The photographs from the inspection have been provided to the Tribunal and show that the premises has been abandoned: furniture appears to have been removed from the premises, there is a significant amount of rubbish and other belongings scattered through the premises, there is furniture and other household items which appear to have been dumped outside the premises, and the garden is significantly overgrown.
- The landlord provided rent records which prove the amount owing at today’s date.
- The premises have been abandoned, and rent is in arrears. For this reason, I am terminating the tenancy immediately.
- All the requirements for an expedited abandonment application have been met. If the landlord has any further claims in relation to this tenancy, the landlord will need to file a new application and pay the corresponding fee.
