[Mr B] attended the hearing for the landlord. The tenant was phoned on the number provided but there was no response to the call.

On 5 March 2026 the Tribunal made an order that the tenant pay the landlord the sum of $955.15 and dismissing the landlord’s claim for costs to find another tenant for the premises. The reasons for dismissing the costs claim are set out in paragraph 4 of the 5 March order.

That same day, 5 March, the landlord applied for a rehearing. A rehearing hearing was held today to consider whether the application should be granted.

Section 105(1) Residential Tenancies Act 1986 provides that the Tribunal has the power to order a rehearing where “a substantial wrong or miscarriage of justice has or may have occurred or is likely to occur”.

Usually the party applying for the rehearing must show that something went wrong with the Tribunal’s procedure, for example, that they did not receive notice of the hearing or they were not able to properly present their case. A rehearing may also be granted where there is new evidence that was not reasonably available at the first hearing, if it could have affected the outcome.

The District Court has held that if the Tribunal was simply wrong in its findings of fact, or its application of the law, this is not sufficient to establish a miscarriage of justice: a rehearing is not an alternative to an appeal. Furthermore, a rehearing will not be granted just because a party is unhappy with the decision, or to give them a second opportunity to present their case.

The sole ground for the landlord’s application for rehearing is that he is unhappy with the decision dismissing the claim for costs incurred to find another tenant and he would like another opportunity to present his case. [Mr B] also said that he could provide evidence (invoices) to support the claim if required.

However, as mentioned above being unhappy with the decision or wanting another chance to present his case is not sufficient to support a rehearing. In addition, the additional evidence that [Mr B] wished to provide was reasonably available at the last hearing.

The application for rehearing is therefore dismissed. Suppression
