New Zealand Tenancy Tribunal Case 5405428 — Tenancy dispute

An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant and Landlord’s name and identifying details.
BY CONSENT - [The landlord/s] must remove from the premises the belongings that are not the tenants (which belong to [The landlord’s partner]’s brother) from the shed/sleepout by 5pm on Friday 6 February 2026.
BY CONSENT - [The landlord/s] and [The tenant/s] agree that [The tenant/s]’s tenancy agreement includes the shed/sleepout and that during the course of the tenancy no one can use/move into that shed/sleepout without the consent of [The tenant/s].
BY CONSENT – The parties agree that the notice given to the tenant to terminate the tenancy dated 30 December 2025 ending the tenancy on 10 February 2026 is not valid and that the tenancy will continue.
[The landlord/s] must pay [The tenant/s] $28.00 immediately, being reimbursement of the filing fee.

Reasons

Both parties attended the hearing. The tenant attended in person.
After seeing a text message exchange between the tenant and the landlord this morning I telephoned the landlord who had not appeared in person because a text message indicated he wanted to attend by telephone.
I allowed him to attend by telephone with a reminder that such requests would usually need to be made in advance to the Tribunal.
Adjudicator Koller made an earlier order in this application on 20 January 2026. In that order she ordered that the landlord is [The landlord/s]. Adjudicator Koller also listed the tenant’s claims. These are: i. An order that [The landlord’s partner]’s brother’s dog is removed from the tenancy address. ii. An order that [The landlord’s partner]’s brother’s belongings are removed from the tenancy address. iii. An order no one else can move in without the tenant’s consent. iv. An order the notice served on 30 December 2025 and ending the tenancy on 10 February 2026 is not a valid notice. v. An order for suppression.
The tenant says there is no longer an issue with a dog so that does not need to be heard but the other issues still need resolving.
I heard how there is a written tenancy agreement for the premises. The tenant and the landlord as named are the only parties.
The parties agree that the tenancy agreement includes the tenant renting the two-bay garage with an attached sleepout at the property.
The parties agree that a separate room off the main house has always not been part of the tenancy. The landlord lived there, then the landlord and his partner lived there together and more recently the landlord’s partner (or former partner – I am unclear on this but nothing in this decision turns on this) [The landlord’s partner] is living there. The parties agree that this separate room was not part of the tenancy agreement.
The tenant’s concern is not with that but is that the brother of [The landlord’s partner] moved into the shed/sleepout so the tenant could not use it. The brother is no longer there but the tenant wants his belongings removed. The landlord agreed to remove the items of the brother from the premises by 5pm on Friday 6 February 2026. This is ordered by consent.
The tenant also wants certainty that no one else will move into the shed/sleepout while she is renting it. The landlord agrees that no one should use or live in the shed/sleepout during the course of the tenancy without the consent of the tenant. This is also ordered by consent.
The tenant was given a written notice on 30 December 2025 to end the tenancy by [The landlord’s partner]. The landlord says that [The landlord’s partner] did not have authority to give this notice. The landlord agrees that the notice is not valid and the tenancy is to continue. An order to reflect this is made by consent.
[The tenant/s] has wholly succeeded with the orders she sought today therefore I have reimbursed the filing fee.
Both parties seek suppression of their identifying details (see section 95A Residential Tenancies Act 1986). I award suppression to both parties as both parties were conciliatory, and the result today could have been achieved at a confidential mediation. It is in the public interest that disputes can be resolved expediently and between the parties.
