- The tenancy of [The tenant/s] tenant/s] at 30B Ararino Street, Trentham, Upper Hutt 5018 is terminated, and possession is granted to JEGCO Investments Limited, immediately.
- [The tenant/s] tenant/s] must pay JEGCO Investments Limited $5,232.00 immediately, as calculated below:
Reasons
- Ms Gerbes represented the landlord. The tenant did not attend the hearing. I conducted the hearing by video/phone. I am satisfied that proper notice of the hearing was provided to the tenant.
- The landlord has applied for termination of the tenancy for abandonment, rent arrears, and the filing fee.
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is owing at the hearing date 1 . A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 7 December 2025 the landlord became aware that the tenant had abandoned the premises. An inspection that day showed that the tenant had vacated the tenancy. The next-door tenant advised the landlord that this tenant had left the property the week before. The landlord then spoke with the tenant’s mother who advised that the tenant had moved to the South Island.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
How much does the tenant owe?
- The landlord provided rent records which prove the amount of rent owing at the date the landlord discovered that the tenancy had been abandoned. The landlord is entitled to 21 days’ rent in lieu of notice from that date but has limited the claim for rent until 10 December 2025, the end of the rent period for the week when the landlord discovered the tenancy abandoned.
- As the application is successful, the tenant must pay the landlord’s Tribunal filing fee.
- The landlord is holding the bond of $3,000.00. I have deducted that amount from the landlord’s proven rent claim.
