[The landlord/s] is granted possession of the premises at Unit/Flat Apartment 2211, 8 Airedale Street, Auckland Central, Auckland 1010, Queen's Residences at 9:00am on 5 January 2026.

Reasons

The landlord has applied to the Tribunal for a possession order, requiring that the tenant leave the premises following the expiry of a termination notice.

The tenancy commenced on 27 August 2019. The tenancy is a periodic tenancy. The landlord is “[The landlord/s]”, the sole tenant is Michelle Shortcliffe.

It is the case that the landlord rents the premises from another landlord (who I will refer to in this order as the Head Landlord), but as far as the tenancy agreement is concerned, Ms Shortcliffe is the tenant and her landlord is [The landlord/s].

The Head Landlord issued [The landlord/s] a termination notice, which required that the premises be returned to the Head Landlord on 4 December 2025.

On that basis, on 8 September 2025, [The landlord/s] issue issued a 90 day termination notice to Ms Shortcliffe, terminating her tenancy as of 7 December 2025.

Ms Shortcliffe has not returned possession of the premises to [The landlord/s], so [The landlord/s] now seek a possession order.

I convened a hearing today, on 22 December 2025 by video. The hearing notice gave the parties an opportunity to telephone into the hearing if they wished to do so, but only the landlord attended the hearing today (by video). I am certain the tenant is aware of the hearing, because she has contacted the registry, displeased that the hearing was scheduled prior to Christmas. But in any event, the tenant is aware that the hearing was scheduled, and I am satisfied she had the details to attend if she wished to do so.

As I understand matters, based on what the tenant has said to the registry, and also to the landlord, her belief is that the tenancy could not be terminated because she did not have any legal relationship with the Head Landlord. Unfortunately, the tenant is not correct in that understanding. Her legal relationship is with [The landlord/s] and in this case, it is [The landlord/s] that has issued the termination notice from which this application is based.

Because the notice is a 90-day notice, the [The landlord/s] does not need to have any specific reason in order to terminate the tenancy. While the landlord has explained what the reason is that is, their tenancy came to an end, the fact remains that the landlord ([The landlord/s]) has issued a valid 90-day termination notice, and the tenant has not complied with it. The application for a possession order is granted.

At the hearing today, the Property Manager agreed that given the Christmas shutdown, a sensible possession date would be 5 January 2026. Therefore, the possession order date is 5 January 2026.

For completeness, I note that Ms Shortcliffe must leave the Tenancy no later than 5 January 2026. She must return the premises reasonably clean and tidy, which is the legal obligation on her. She will also be liable to pay rent to the landlord until the date possession is returned. In the event Ms Shortcliffe fails to comply with the order, the landlord can apply to the bailiffs to have Ms Shortcliffe evicted.
