The applicant did not attend this morning’s hearing at the scheduled time. Background
On 11 February 2026, the Tribunal issued an order terminating the tenancy. This was on the landlord’s application 5415507.
On 17 February 2026 a rehearing was granted on the basis that the tenant had not received notice of the hearing because the email address being used had not been provided as an address for service. The order of 11 February was stayed, but it was conditional on the tenant continuing to pay weekly rent of $620.00. The Tribunal said that if any payment was missed by more than two days, the stay would lapse and the original order may be enforced.
The tenant did not pay the rent and so the stay lapsed and by the time of the Case Conference on 2 April 2026, the landlord had commenced enforcement proceedings for possession.
In the minute dated 7 April 2026, following the case conference, it was recorded that because that order was being enforced, the matters before the Tribunal are now the tenant’s application 5412174. It was recorded that if the landlord has any further claims, he must file a new application.
The landlord has filed no new application.
The tenant was directed to file all evidence by 13 April 2026 and the landlord to reply by 20 April 2026. This was in relation to the tenant’s application, 5412174.

If not, he must provide an address for service for Mr [B suppressed].
The same day the parties were advised of a two-day hearing to start on 24 June 2026 at 9.30am.
On 18 May 2026 the landlord duly notified the Tribunal that he represented Mr [B suppressed]. No evidence was filed in response to the tenant’s evidence. Application for adjournment
On 22 June 2026 the parties were advised that the start time for this morning’s hearing was to be delayed by half an hour from 9.30am to 10.00am.
That evening the tenant emailed the Tribunal asking if the landlord had filed anything.
At 9.35am yesterday, 23 June, the Tribunal emailed the tenant copies of documents from the landlord’s file.
The landlord had filed some documents on the morning of 23 June.
At 12.13pm the tenant emailed asking when the documents had been filed and asked for an adjournment. He said:

When were these provided?

I have been waiting since April for landlords information, but I was never included or sent these. There has been a miscarriage of justice here. The landlord did not provide these to me by CCing me / including me, so any information past the last tenancy hearing (case conference), I do not have. The court / tenancy has not provided me a copy of these I formally requesting adjournment so I have time to review and go through these. Less than 24hours before hearing is not sufficient time.

The Tribunal replied at 14.54 that a copy of the documents were emailed on 21 January 2026 alongside a notice of hearing for 11 February. 1

The tenant replied at 4.33pm yesterday that he still required an adjournment.
The application for an adjournment was not processed before the hearing was called this morning at 10am at which time the landlord was present, but the tenant was not. Attempts were made to reach the tenant, as recorded in the following minute issued at 10.11am: Yesterday the tenant applied for an adjournment on the grounds that he had not received documents from the landlord. The application for an adjournment was brought to my attention this morning. The adjournment had not been granted and so the matter was called at 10am. The email address is the same one that the tenant has been using to communicate with the Tribunal and specified in the directions issued on 2 April 2026. that his application for an adjournment had not been granted. Three phone calls to the tenant have gone unanswered. If the tenant does not attend, the matters will be determined in his absence.

If a party files evidence out of time, the Tribunal usually disregards it, unless the other party does not object. If there are strong reasons why the evidence is filed late, then the Tribunal may decide to accept it, and, if the other party is prejudiced by the late filing, an adjournment is granted.
If the tenant had attended today, and objected to the inclusion of the late evidence, then the starting point would be that the landlord’s evidence filed on 23 June would have been excluded. The hearing could have proceeded on the basis of everything that had been filed by 18 May. The tenant chose not to attend to argue his case, even when advised that his application for an adjournment had not been granted and given further time to get to the hearing.
