Reasons
- The landlord attended the hearing by phone call.
- The tenant did not connect to the MS Teams hearing and was telephoned on the phone numbers provided but the phone calls were unanswered. The tenant was served by post to the tenancy address, being her address for service. The hearing proceeded in her absence. 1
- The landlord has applied for possession of the premises following the termination of the tenancy. 1 See s 91A, 91B and92
- The tenancy ended on 27 November 2025 pursuant to a termination notice dated 25 August 2025. The termination notice meets the requirements set out in section 51 of the Residential Tenancies Act 1986.
- Pursuant to the notice, the tenancy ended less than 90 days ago.
- The requirements of section 64(1) of the Residential Tenancies Act 1986 are therefore satisfied, and the Tribunal is required to make a possession order.
- I have made an immediate possession order which, however, remains subject to the 48 hour “stand down” period relating to enforcement proceedings. 2
- The landlord applied for name suppression and because they have been successful with the claim I have made an order suppressing the landlord’s name and identifying details.
