The landlord attended the hearing. One of the named tenants attended, however, the other two did not and the hearing proceeded in their absence.

The landlord filed a claim for termination for rent arrears. The landlord had issued a 14-day notice for rent arrears in accordance with section 56 of the Residential Tenancies Act 1986 (RTA).

When rent was not paid, the landlord filed an application with the Tribunal. However, since then there has been a mediation (where one tenant did not agree), and delays in scheduling the hearing.

The tenants have now paid the outstanding rent and are no longer in arrears, however, the landlord does still seek termination of the tenancy.

Section 56(1)(c) of the RTA states that the Tribunal may make an order terminating the tenancy if the Tribunal is satisfied that: a. The other party has committed a breach of any provisions of the tenancy agreement, for example failing to pay rent. b. In the case of the breach capable of remedy, the applicant gave the other party a notice specifying the nature of the breach complained of and requiring the other party to remedy the breach within a reasonable time period, being not less than 14 days. c. That the breach is of such a nature or of such an extent that it would be inequitable to refuse to make an order terminating the tenancy.

The tenants did commit a breach of the tenancy agreement, and the landlord did issue a 14-day notice for the breach of unpaid rent.

Although I appreciate the landlord’s frustration in the process, the difficulties with the tenants and the time taken for the arrears to be paid, I do not find in the circumstances, and now that rent has been fully paid, that it would be equitable to terminate the tenancy.

The claim for termination is dismissed.

Because [The applicant/s] has only incurred the filing fee through the delays in payment by the tenants, I have however reimbursed the filing fee.

The tenant that attended requested name suppression. This is granted on the basis that the arrears were paid and the claim for termination was dismissed. I also consider it appropriate to suppress the name of the landlord and consider that the private interests of both parties outweigh any public interest in publication of names.
