Reasons

All of the parties attended the hearing.

It became apparent the landlord had not been served with Tribunal documentation concerning the case due to it being posted to the tenancy address and the property has been sold. A brief adjournment took place so the Tribunal could provide a hard copy of the documentation to the landlord.

The claim was then case managed with the tenants’ expressing their claims as follows: a) A rent increase in 2024 was unlawful when rent was increased after a flat mate occupied the premises (rent $880 per week – claimed an overpayment of $3,640) b) For the breaches below the tenant seeks compensation of $3,860: a. That the landlord failed to give notice when entering the property on the following days: i. 26.2.23 (same day – 1 hr notice) ii. 12.4.24 (next morning entry) iii. 17.4.24 (same day for insurer builder) iv. 1.6.24 (immediate) v. 2.6.24 (same day entry) vi. 11.7.24 (immediate entry) vii. 1.8.24 (same day entry for furniture) viii. 3.11.25 (20 minute’s notice) ix. 2.10.25 (inspection notice given the night before) b. That in breach of notice requirements and breach of quiet enjoyment not enough notice was given for contractor access and the tenant was only told that the kitchen or dining room would be subject to the work when other rooms were also impacted. c. A failure to maintain the deck. d. A failure to investigate mould in a timely way. e. Breach of quiet enjoyment due to personal belongings being photographed in marketing pictures of the home when it was for sale. f. Breach of notice requirements and breach of quiet enjoyment to the landlord pushing for open homes and viewings for the sale of the property. g. Failure to give notice and breach of quiet enjoyment for coming and painting the exterior of the house on 5 November.

The Tribunal then heard evidence and submissions relating to the tenants’ rent claim because the landlord had expected to deal with this today. The remainder of the claim was going to be adjourned and heard at a later date.

However, the parties wanted a chance to negotiate and, while this began with the parties exploring just the rent claim it quicky expanded into settling all of the claims bought by the tenant so that all claims arising between the parties out of the tenancy could be settled and so that the parties had knowledge that all issues arising out of the tenancy were complete.

The parties ultimately agreed for the landlords to pay the tenants $3,300 full and final settlement of all claims arising between the parties arising from this tenancy by Friday 13 March 2026.
