Reasons

The hearing was conducted on Microsoft Teams.
Katherine Rewi attended the hearing for the landlord.
The tenant attended for herself.
The landlord claims the tenant is liable for blocking the toilet. The tenant denies blocking the toilet.
The applicant is required to establish the claim to the civil law standard of proof, on the balance of probabilities.
The toilet was not flushing well at the end of the tenancy. A plumber was called in who cleared the drains. When the new tenancy began, the tenants reported the toilet was blocking. A plumber was called in again who dismantled the toilet and found a section of wire lodged in the toilet.
The tenant readily accepted responsibility for other issues following the tenancy ending including the cost of cleaning the garage and water rates. The tenant lived in the premises for 10 years and were reliable and careful tenants.
I found the tenant believable and reliable. Having heard from the tenant and her daughter who lived in the premises, I am not satisfied that they carelessly or deliberately blocked the toilet. That being so, I cannot find the claim proven.
It is dismissed.
The bond is to be released to the tenant.
The tenant asks for non-publication of her name and identifying details. She has wholly succeeded in the proceedings. I do not consider that publication is otherwise in the public interest or is justified because of the tenant’s conduct or any other circumstances of the case. The Tribunal orders non-publication as requested.
