Order

- The tenancy of Ammy Hull (aka Ammy Thorn) at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], immediately.
- Ammy Hull (aka Ammy Thorn) must pay [The applicant/s] $15,572.29 as follows:
Reasons
- The landlord attended the hearing. The tenant did not attend and could not be contacted on the phone number given in the Notice of hearing, which was properly served.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- In her application the landlord indicated a concern that the tenancy has been abandoned. Her evidence is that the tenant was still occupying the premises when the landlord went there to serve proceedings on her in December 2025. There was some discussion about the tenant vacating, but the landlord has been unable to contact the tenant since then and as far as she is aware the tenant remains in occupation.
- In those circumstances, there is no abandonment date from which the tenant’s liability for rent should be limited. 1
- Because the arrears are extensive, I have considered whether the landlord has met her obligation to take reasonable steps to limit the losses claimed. 2
- Although this application has taken some time to be heard, the file does show that within a reasonable period of the arrears beginning to accumulate, the landlord brought an application seeking termination of the tenancy.
- There is no basis for the tenant not being required to pay rent to the end of the tenancy in terms of this Order.
- Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.
