Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the parties’ names and identifying details, except Audrey Bei.
- The tenants owe the landlord $7,068.00 (“the debt”). This amount is $7,040 for rent and $28.00 for the filing fee.
- The tenants must pay rent and the debt as follows: a. By 8 weekly payments of $1,760.00, being $880.00 for rent and $880.00 for the debt. b. A final payment of $908.00. c. Tenant A will make a payment $880.00 today and another payment of $880.00 on Saturday 28 February, being the first payment of $1,760.00. 25/04/2026everySaturday.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenants fail to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenants fail to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- Audrey Bei did not attend the hearing. She was a party to this fixed term tenancy and is liable for the debt. Tenant A stated that Audrey signed the Tenancy Agreement but changed her mind about living at the property on the day the tenancy began.
- A party to a tenancy cannot unilaterally end their contractual obligation.
- Tenant A has been informed that she is able to make a claim against Audrey Bei in the Disputes Tribunal for the losses Tenant A has had as a result of Audrey not paying her share of the rent.
- The landlord applied for termination of the tenancy, rent arrears and the filing fee. The tenant stated that she has the prospect of another tenant joining her at the property and wants to repay the debt to avoid immediate termination. The landlord has agreed to the payment plan set out above.
- Because the landlord has been successful with the claim the filing fee of $28.00 will be also be paid by the tenants.
