Reasons
- The landlord attended the hearing. Two attempts to reach the tenant went unanswered.
- The landlord has applied for $6057.00 being the balance in rent arrears owing after the bond had been deducted. The landlord has provided rent records which have two errors. One is that he miscalculated a shortfall in May 2025 by $10. That amount has been owing, making $7,697.50 instead of the $7,687.50 as claimed. However, there is another error. According to the application the tenancy ended on 6 December, but the rent summary runs to 11 December. Therefore 5 days ($403.57) has been deducted from the total owing, bringing it to $7,293.93, as shown in the table.
- The landlord had also submitted an invoice for $322.00 for repair of glass. He had provided no photographs of the premises at the start or end of the tenancy. Before and during the hearing, he was provided an opportunity to email entry and exit inspection photographs. He was unable to do so. Some photographs were received before the hearing, but they were from the tenant.
- The invoice submitted is to “reglaze window street side.” The landlord said that was for the front door. He was invited to provide the photographs by the end of the day.
- The landlord duly provided some photographs of the back door.
- The landlord has not proved that the damage referred to in the invoice occurred during the tenancy and so this claim is dismissed.
