Reasons

Both parties attended the hearing.
On 7/1/2026 the tenant filed an application for refund of the bond, and compensation and exemplary damages for failure to provide a written tenancy agreement, failure to lodge the bond, breach of quiet enjoyment and healthy homes standards.
In disputing the claims, the landlord relied predominantly on the exemption in section 5(1)(n).
After significant submissions and the likelihood of an adjournment for further evidence the parties reached an agreement.
The tenant withdrew the application.
Suppression is granted to both parties as I consider it reasonable to do so because they reached an agreed settlement.
