Does the Tenancy Tribunal have jurisdiction under s 77 RTA?

Reasons

The applicant says they moved into [suppressed] on 14 May and paid weekly rent directly to Janvi Dholakia, while repeatedly asking Janvi and another flatmate, Vrushik, to be added to the tenancy.
They say they were wrongly told the tenancy “cannot hold more than four people”, were not given a lawful bond/tenancy process, and the Landlord was not informed until mid-November 2025.
The Applicant seeks repayment or adjustment for alleged unaccounted rent and overcharging.

Does the Tenancy Tribunal have jurisdiction under s 77 RTA?

Under s 77(1), the Tribunal can determine disputes between a landlord and a tenant, or between a landlord and a tenant’s guarantor, relating to a tenancy to which the Act applies.
On the applicant’s own account, the complaint is principally about conduct by other occupants/head tenants (rent collection, representations about being added to the tenancy, and accounting for payments), not about the landlord’s conduct. That is, in substance, a dispute between occupants, not a landlord–tenant (or landlord–guarantor) dispute within s 77(1).
If accurate, accepting rent/bond-like payments without transparent accounting and discouraging a straightforward variation process is seriously concerning. However, the Tribunal cannot determine those issues if it lacks jurisdiction.
Consequently, the Tribunal declines jurisdiction under s 77 RTA and the application is dismissed for want of jurisdiction.
I have granted the tenant’s name suppression request but do not afford name suppression to the Respondent because I consider it is the Respondent’s conduct, on balance, which has led the tenant to file this application, seeking redress.
