Order
- This application is struck out.
Reasons
- This application was scheduled to be heard by video conference. The respondent did not connect to the Teams link provided to him and nor did he ring in to the hearing as directed in the Notice of Hearing sent to him. The hearing proceeded in his absence.
- The applicant has made a claim against the respondent in the Tenancy Tribunal, seeking among other things, payment of the bond.
- The Tenancy Tribunal has jurisdiction to hear claims between landlords and tenants. Section 5 (n) of the Residential Tenancies Act 1986 specifically excludes the Tribunal from hearing claims where the premises, not being a boarding house, continue to be used during the tenancy principally as a place of residence by the landlord.
- The parties here are flatmates, not tenants, and have been described as such in the rent summary. The landlord lives at the premises.
- Further to this, it is not a boarding house as defined in s 66B of the Residential Tenancies Act 1986 – premises containing 1 or more boarding rooms along with facilities for communal use and occupied, or intended to be occupied, by at least 6 tenants at any one time.
- The Tenancy Tribunal therefore does not have the jurisdiction to hear this claim and so it is struck out. C ter Haar 14 May 2026
