Reasons
- Ms Davis, representing the landlord, attended the video conference hearing. The tenant did not join the hearing as per the instructions in the Notice of Hearing and so did not attend the hearing. As the tenant was served, the hearing proceeded in her absence.
- The landlord has applied for compensation following the end of the tenancy.
- The landlord said the tenancy ended on 16 December 2025.
- The landlord said the tenant has a remaining rent credit of $36.86 and that the landlord has received the bond of $232.00, both of which can be applied to any order made against the tenant. Therefore, the total to be applied for the credit of the tenant is $268.86.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The landlord said the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
- The landlord provided an Exit Inspection Report dated 16 December 2025 with photographs of the condition of the property, work orders, correspondence to the tenant and other evidence. Cleaning
- The landlord claimed $52.33 for cleaning the rangehood at the end of the tenancy, pointing to photographs of the rangehood which showed it being very dirty. I find the tenant did not leave the rangehood clean and find the landlord’s claim to clean the rangehood in the amount of $52.33 to be reasonable, given the evidence. Therefore, I award the landlord $52.33 for cleaning the rangehood at the end of the tenancy. Rubbish removal
- The landlord claimed $266.03 for removing and disposing of rubbish left in the shed, $1,523.63 for clearing and removing rubbish left outside the property, and $18.37 to remove and dispose of a tyre, all left at the end of the tenancy, for a total rubbish removal and disposal claim of $1,808.03.
- The landlord highlighted a number of photographs in the Exit Inspection Report which showed a broom, large green tarp, plastic sheeting, wooden boards, old bottles and old clothing and other rubbish left in the shed. The landlord said the shed rubbish amount of 1.5 cubic metres to be removed. Given the evidence provided, I find the tenant did not remove this rubbish and find the cost claimed by the landlord to remove the shed rubbish to be reasonable. Therefore, I award the landlord $266.03 to remove and dispose of rubbish from the shed at the end of the tenancy.
- The landlord pointed to a number of photographs in the Exit Inspection Report showing rubbish left outside the property at the end of the tenancy, including plant pots, bricks, corrugated iron sheeting, netting, old rubbish bins with organic waste, tall rubbish bins that were full, a large pile of rubbish left outside the house (which had boxes, tarps, tyre rim, red metal frame and much other rubbish in it), a basketball hoop and other rubbish items. The landlord said there were 8.5 cubic metres of rubbish removed from the exterior of the property, despite the tenant’s apparent efforts to clear other items and rubbish before she left. The landlord claimed $1,523.63 to remove the exterior rubbish and $18.37 to remove one tyre left at the property. I find both amounts claimed to be reasonable given the evidence provided and so award the landlord $1,542.00 to remove exterior rubbish and the tyre left at the property at the end of the tenancy. Therefore, along with the shed rubbish claim awarded above, the total rubbish removal and disposal awards comes to $1,808.03.

- As per above, I apply the total credits for rent and the bond to the tenant totalling $268.86 against the orders made against the tenant.
