Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by having multiple animals on the premises including livestock. The landlord has had multiple complaints from the local community involving alleged animal cruelty and ongoing untidy and insanitary conditions. The landlord confirmed that Auckland Council, SPCA, and Police, have all been involved.

The landlord served a 14-day notice on the tenant on 9 December 2025 and again on 8 January 2026, and the tenant did not remedy the breach within the required period. However, the landlord confirmed they went out to the premises in late January, and by that time all of the animals had been removed. The landlord says there is a strong rotting stench emanating from the garage.

I find it would be inequitable to refuse to terminate the tenancy because of the seriousness of the breaches which has caused considerable upset in the local community. I also share the landlord’s concerns that the breaches may be repeated as this has been a pattern of ongoing behaviour.

The landlord has requested possession of the premises on 19 April 2026 to give the tenant fair opportunity to find alternative accommodation and fulfil their outgoing tenant responsibilities.

Because [The applicant/s] has wholly succeeded with the claim, the tenant must reimburse the filing fee.
