Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 8 January 2026, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.

The landlord said the tenant had not been paying rent, nor had he been responding to multiple attempts to contact him. The landlord provided a notice to enter the property, concerned the property was abandoned, on 7 January 2026 and entered the property on 8 January 2026, when the landlord found the property vacant. The landlord provided photographs of the condition of the property upon entry, which showed most rooms inside the house were empty and there was some old furniture and other rubbish scattered throughout the property. The landlord also provided copies of messages between the parties. From the evidence provided, I am persuaded by this evidence that the tenancy has been abandoned.

The tenant has not contested the claim.

The landlord provided rent records which show there were rent arrears at the date of filing the application.

All the requirements for an expedited abandonment application have been met. Because the premises have been abandoned, and rent is in arrears, I am terminating the tenancy immediately. Suppression

The landlord requested name suppression, which I grant as they have been successful with the claim. Therefore, I order that the landlord’s name and identifying details and the tenancy address are not to be published. See section 95A(1) Residential Tenancies Act 1986.
