On 24 October 2025, the tenant filed an application seeking: a. Compensation for breaches of the healthy homes standards. b. Compensation for fail to maintain the property. c. Compensation for failure to provide HHS information. d. Compensation for retaliatory notice. e. Exemplary damages. f. Reimbursement of the filing fee.
On 14 January 2026, the landlord filed a cross application seeking; a. Rent arrears. b. Reimbursement of the filing fee.
[Property Manager], Property Manager, appeared on behalf of the landlord.
The tenant appeared.
At the hearing, the parties agreed to: a. Immediately withdraw all claims against each other. b. Not pursue any further legal action against one another for any matters arising out of this tenancy. c. Work together to assist the Police with any criminal investigation into alleged offending arising from the management of this tenancy.
Under section 95A of the Act a party who has been either wholly or substantially successful is entitled to name suppression unless the Tribunal finds that there are reasons relating to the conduct of the party not to do so.
Given the matter was resolved by consent, the Tribunal considers that it is appropriate to order suppression of the tenant and landlord’s name and identifying details.
No order for costs is made.
