Reasons
- The landlord attended the hearing, the tenant did not attend. The tenant was served with the notice of hearing and has not communicated with the Tribunal seeking an adjournment of the hearing. I rang the tenant three times on two mobile numbers at the start of the hearing. The calls went unanswered and went to an answerphone. I am proceeding with the hearing in the absence of the tenant.
- The landlord has applied for termination of the tenancy, rent arrears and reimbursement of the filing fee. Termination:
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The tenancy is terminated at 11.59pm on Thursday 23 rd April 2026 and after that date and time the landlord has possession of the property. Rent arrears:
- The landlord provided rent records which prove the amount of $11,680.00 owing at the end of the tenancy on 23 April 2026.
- I am satisfied that the landlord has proven the rent arrears owing. Filing Fee:
- Because Simon Johannes Broekhuizen has wholly succeeded with the claim I must reimburse the filing fee. Obligations at end of tenancy:
- The Tribunal has ordered the termination of the tenancy due to significant rent arrears. It is important that the tenant comply with this termination and meet the obligations under both the tenancy agreement and the Residential Tenancies Act 1986 regarding the end of the tenancy. This includes vacating the premises by the required date, returning all keys, and leaving the property in a reasonably clean and tidy condition. If the tenant does not comply with these obligations, the landlord may incur further costs in regaining possession or remedying any breaches, and the tenant may be ordered to pay these additional costs.
