Decided 1 Apr 2026 · Published 1 Apr 2026 · Application 5429583
- Rent arrears
Party names are redacted in the official published order.
Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord name and identifying details.
- Ms Meredith will pay the rent arrears (currently $2,860.00 to 15 February 2026) before 29 March 2026, and will also pay the usual weekly rent ($460.00) until 29 March 2026.
- If Ms Meredith pays all of the arrears and ensures the rent is up to date as at 29 March 2026, the landlord will enter into a new tenancy with Ms Meredith.
- If there is any amount of arrears as at 29 March 2026, the tenancy will end on that date and possession will be granted to the landlord from 30 March 2026. Any rent arrears owed will be payable to the landlord immediately.
- Ms Meredith is to pay [The tenant/s] $28.00 immediately, being the filing fee for this application.
Reasons
- Ms Meredith is in a fixed term tenancy that is due to end on 29 March 2026. The rent is $460.00 per week. In December 2025 Ms Meredith stopped paying rent and could not be contacted.
- The landlord filed this application seeking termination of the tenancy through the expedited abandonment process.
- On 3 February 2026, the Tribunal made an order not granting termination, and referring the application to a full hearing.
- On 10 February, Ms Meredith made contact and paid $2,000.00 towards the rent arrears.
- The hearing took place by video conference on 16 February. Both parties participated in the hearing. [The landlord’s representative] represented the landlord.
- At the hearing Ms Meredith said that she wanted to continue with the tenancy and enter into a new tenancy after 29 March.
- [The landlord’s representative] said that the landlord is willing to grant a new tenancy after 29 March, and to provide an invoice to Ms Meredith to assist her with scholarship funding for the next period, but only if Ms Meredith clears the arrears before the end of this tenancy.
- The arrears are $2,860.00 to 15 February 2026.
- Ms Meredith said that she would clear the arrears and pay rent to the end of the tenancy.
- I have made orders above recording the terms of the agreement.
- The landlord has been successful in this application, and I must also award the landlord the filing fee of $28.00.
- The landlord sought name suppression. Name suppression is granted on the grounds that the landlord substantially succeeded in the proceedings.
