The tenant said that in March 2026 she began an application for hardship withdrawal of Kiwisaver funds, but indicated that she had yet to provide them with further information to progress this application. The tenant said she was able to pay $80.00 weekly towards arrears as well as current rent but could not pay the full arrears owing for about a month. The landlord said the owner is not able to continue to carry the debt, as they have already been carrying the rent arrears debt for a significant time.

Given the history of rent payments in the rent summary provided for this short tenancy that only began on 12 January 2026, and the evidence discussed and provided at the hearing and before the hearing, as outlined above, I am not satisfied that the debt will be paid within a reasonable time or that it is unlikely the tenant will commit any further rent payment breaches. Therefore, I decline to make a conditional termination order. See section 55(1A) Residential Tenancies Act 1986.

Therefore, I order that both parties’ names and identifying details and the tenancy address are not to be published. See sections 95A(1) and 95A(4) Residential Tenancies Act 1986.
