Reasons
- The landlord attended the hearing on 25 February 2026. The tenant did not.
- I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend. I note the tenant is currently on remand and has been refused bail but the notices of hearing and evidence to support the landlord’s claims have been sent to the relevant remand prison facility. The landlord confirms the tenant initially kept close contact with it but since her bail was refused, she had ceased all communications with it.
- The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.
Should the tenancy be terminated?
- The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
- Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
- The tenant has breached their obligations by failing to meet their statutory and contractual obligations to pay their rent in full and on time.
- The landlord served a 14-day notice on the tenant on 26 November 2025, and the tenant did not remedy the breach within the required period.
- It would be inequitable to refuse to terminate the tenancy because the tenant is in significant rent arrears, has not made contact with the landlord to arrange a repayment plan that is mutually acceptable to both parties, is currently in a situation where she is unlikely to have the income to repay the debt and to meet her rent obligations going forward. Additionally, the landlord has no information about when the tenant may be able to return the premise and she has a contractual obligation to occupy the premise and she is in breach of that occupation obligation, a breach which is incapable of remedy.
