Should the tenancy be terminated?

Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlords name and identifying details.
The tenancy of Todd Cantrill Tikiku at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], immediately.

Reasons

The Landlord attended the hearing. The Tenant did not appear.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached their obligations by breaching the neighbouring Tenants quiet enjoyment.
The landlord served a 14-day notice on the tenant on 2 January 2026 and the tenant did not remedy the breach within the required period.
It would be inequitable to refuse to terminate the tenancy because there have been multiple complaints from the neighbours for over three months, regarding the loud music being played at all hours of the day and night, the Tenants talking loudly and the Tenant or their visitors blocking traffic when they would park their cars up the driveway. Email messages from the neighbours were provided to support the noise complaints and complaint to Noise control. The landlord also stated that some of the neighbours had moved out due to the constant noise caused by the Tenant.
As the Landlord has been wholly successful with their claim, name suppression is granted to the Landlord.
