Reasons
- The landlord attended the hearing held on 3 March 2026 by video.
- The landlord applied for termination of the tenancy and disposal of goods on the basis that the tenant was admitted to hospital and then transferred to a rest home for care.
- Since filing the application, the tenant has passed away. I am told that he passed away on 18 February 2026.
- The issue arises as to who is the tenant’s personal representative. The landlord advised that the tenant’s wife, who he was separated from, has been cleaning and clearing out the premises.
- The landlord provided the contact details for the tenant’s wife, [The tenant’s wife]. [The tenant’s wife] was joined to the hearing by telephone.
- [The tenant’s wife] advised that the tenant’s will has been located and she is named as the executor of his estate. I am satisfied that [The tenant’s wife] is the personal representative for the tenant.
- The tenant was the sole tenant at the time of his passing. The landlord has applied for termination of the tenancy pursuant to section 50A(2) of the Residential Tenancies Act 1986. It is appropriate for the tenancy to be terminated, and an order is made.
- As [The tenant’s wife] has emptied the tenant’s belongings from the premises an order to dispose of goods is no longer required so that claim is withdrawn.
- An order is made suppressing the names of the parties, the name of the tenant’s representative and the address of the tenancy pursuant to section 95A(4) of the Residential Tenancies Act 1986.
