- The application is dismissed.
- The Tribunal orders suppression of the respondent’s name and the address of the property.
Reasons
- The applicant attended the first hearing by video call. He did not attend the second hearing. He was phoned on the phone number provided but the phone call went to voice mail.
- The respondent did not attend the hearings but was served to the tenancy address. The applicant said the respondent resides at the tenancy address in the application form. I phoned the respondent on the phone number provided at the commencement of the second hearing; however the phone call went to voice mail.
- At the start of the first hearing, I raised with the applicant that there appears to be an issue as to whether the Tenancy Tribunal has jurisdiction.
- At that hearing the tenant indicated this was a flatmate situation (to which the exclusion in s 5(n) RTA potentially applied) and it appeared to not be a dispute between landlord and tenant however I considered that to determine the matter fairly I would allow the tenant to file documentary evidence.
- I adjourned the first hearing and made directions for the tenant to file further evidence. The tenant has not done so. I have determined to dismiss the claim because the tenant has not pursued the claim by attending the second hearing, the tenant indicated at the first hearing that this is a dispute between flatmates and the respondent is not the owner or landlord and crucially, he did not file any documentary evidence to support the claim, in terms of proof of payments and bill statements. 1 The claim is dismissed.
- I am suppressing the respondent’s name and the address of the property given I am dismissing the claim. The applicant did not seek name suppression. 2
