On 13 November 2025. [The tenant/s] was sent a reminder, which he acknowledged. That notice stated that it was a reminder about the notice given on 28 October. It said that “As stated in that notice. The property has been placed on the market for sale and vacant possession is required. You are required to vacate the property by 26 January 2027 – 90 days from the original notice.”

The intended date was 26 January 2026.

The Tribunal has to decide whether the reminder overruled or invalidated the original, valid notice.

I find that it didn’t.

Landlords are able to revoke valid termination notices. 4 The reminder was clearly intended as a reinforcement of the prior notice, not a cancellation of it.

The date of 27 January 2027 was an obvious error – it is not consistent with the clear intent that the tenancy end, in terms of the October notice ”...90 days from the original notice.” There is no evidence suggesting the [The tenant/s] was misled.

Because the Tribunal’s finding is that the tenancy has been validly terminated by notice. An Order for immediate possession is appropriate.
