Should a conditional termination order be made?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. Given the prior notices and time for remedy granted that has not resulted in resolution of the issues, I consider it inequitable to not grant the landlord termination at this time.

Despite my finding that it would be inequitable to refuse to terminate the tenancy, having considered the evidence and submissions from both parties, I am granting a conditional termination. See section 78(3) Residential Tenancies Act 1986. There has been some limited progress outside although the tenant stated she has received positive feedback regarding the inside. That cannot be confirmed evidentially as the most recent inspection was of the outside only. It is hoped this order will assist the tenant access the third-party support she needs to remedy the issues and to enable this tenancy to continue. The consequences of failing will mean this tenancy ends.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

I wish the tenant every success with remedying the issues as required. I remind her again that for this to result and the tenancy continue she needs to drive remedial action from here, including sourcing assistance as required and available.
