Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.
- The tenancy of Krishaan Lal, Isaac Prasad and Abdulaziz Sarkout at Unit/Flat Apartment 603, 161 Victoria Street, Te Aro, Wellington 6011 is terminated, and possession is granted to [The landlord/s], at 3pm on Wednesday 4 March 2026.
- The Bond Centre is to pay the bond of $2,880.00 ([Bond number suppressed]) to [The landlord/s] immediately.
- Krishaan Lal must pay [The landlord/s] $7,323.00 immediately, calculated as shown in the first table below.
- Abdulaziz Sarkout must pay [the landlord]
- $5,032.14 immediately, calculated as shown in the second table below.
- The liability of these two tenants is joint and several and so the total sum recoverable from them under this order must not exceed $7,323.00.
- This order may be enforced immediately.
Reasons
- Only the landlord attended the hearing.
- The landlord has applied for termination of the tenancy, rent arrears and payment of the bond.
- Rent was at least 21 days in arrears on the date the application was filed and so the tenancy is terminated under s55(1)(a) of the Residential Tenancies Act 1986.
- The landlord provided rent records to prove the amount owing at the end of the tenancy.
- Mr Lal and Mr Prasad were the original tenants when this tenancy began on 6 May 2025.
- On 10 July 2025 there was a change of tenants when Mr Prasad was released from the tenancy and Mr Sarkout was added to the tenancy.
- At that time rent arrears were $2,262.86.
- It follows that Mr Prasad’s liability for rent arrears is limited to $2,262.86. Because that is covered by the bond, he has no further liability.
- Mr Lal is liable for the rent arrears in full in the sum of $10,175.
- Mr Sarkout is liable for rent arrears in the sum of $7,912.14 ($10,175 - $2,262.86).
- I have ordered the payment of rent arrears accordingly.
- The landlord has been successful and so I have awarded the filing fee and granted the landlord’s request for name suppression.
