Reasons

This decision relates to an application filed by the landlord seeking termination of the tenancy due to rent arrears. The hearing was held by teleconference on 31 March 2026. The landlord attended. I am satisfied that the tenant was served with notice of the hearing in accordance with the requirements of the Residential Tenancies Act 1986 and it was appropriate to proceed in the tenant’s absence.

The tenancy commenced on 11 December 2025. The weekly rent was $550.00 and a bond of $2,200.00 was paid.

The landlord initially applied for termination of the tenancy on the basis of rent arrears. However, following the filing of the application, the parties reached agreement and entered into a mutual agreement to end the tenancy on 6 April 2026. In support of this, the landlord provided a written mutual agreement signed by both parties on 27 March 2026, together with a signed bond refund form. The agreement records that the bond would be released in full to the landlord to cover rent arrears to the end of the tenancy, calculated at $2,200.00. Assessment

Although the tenant did not attend the hearing, I am satisfied on the evidence before me that the parties reached a clear and mutual agreement to resolve the matters in dispute. The signed agreement dated 27 March 2026 and the signed bond refund form provide reliable and contemporaneous evidence of that agreement.

In those circumstances, it is reasonable for the Tribunal to accept and give effect to the parties’ agreement.

The Tribunal has authority under the Residential Tenancies Act 1986 to make orders reflecting agreements reached between parties, where those agreements are lawful and appropriate. I am satisfied that the agreement is clear, relates directly to the issues in dispute, and is not inconsistent with the Act.

Given the matter has been resolved by agreement and involves personal financial circumstances, I am also satisfied that suppression of the names and identifying particulars of both parties is appropriate.

The landlord also agreed to waive recovery of the filing fee.
