Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.
- Lavinia Kairau owes [The landlord/s] $4,218.00 comprising rent arrears to 25 May 2026 of $4,190.00 and the filing fee of $28.00 (‘the debt’).
- Lavinia Kairau must pay rent and the debt as follows: a. By weekly payments of $740.00, being $670.00 for rent and $70.00 for the debt. b. Payments will be every Tuesday with the first payment on 26 May 2026 and continuing until the debt is paid in full.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at Unit/Flat Flat 1, 26 Tamworth Close, Manurewa, Auckland 2102 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- The landlord’s representative attended the hearing which I conducted by video/phone. The tenant did not attend. I also heard evidence from the owner of the property who provided a rent summary for the period when he managed the tenancy before he instructed a property manager around August 2025.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order 1 .
- The owner of the property confirmed that his rent summary was correct. He also confirmed that he is prepared to accept payment of the rent arrears at $70.00 per week as a minimum; more would be better.
- I have limited the order to a payment of $70.00 per week. The tenant can pay more than that if she is able, but the amount set is the minimum she must pay.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order the possession order may be enforced for 90 days from the first breach 2 .
