The landlord has never agreed to the tenant’s continued unlawful occupation. Therefore, the tenant is a squatter in terms of s 65 of the Residential Tenancies Act 1986 (RTA) are satisfied. That provision states: Where, on the application of any person entitled to possession of any residential premises, the Tribunal is satisfied that any other person is in possession of the premises as a squatter or trespasser, or otherwise than pursuant to any right of occupation granted to that person by any person having lawful authority to grant that right to that other person, the Tribunal shall make a possession order granting possession of the premises to the applicant.

It follows, the Tribunal must make a possession order in favour of the landlord. The landlord kindly asks for the order to be delayed until the end of Monday so that the tenant and son have time to move out with dignity.

The landlord seeks non-publication. The landlord having wholly succeeded with its claim and there being no countervailing considerations is entitled to non- publication pursuant to s 95A(1) of the RTA.

The landlord invites the Tribunal to order non-publication of the tenant’s details for compassionate reasons. The tenant has various challenges including that she has previously been the victim of domestic violence. Also, she has a thirteen- year-old son. It is undesirable that she and her son should be disadvantaged in trying to find suitable accommodation. I am satisfied that non-publication is in the public interest and meets the requirements of s 95A(4) of the RTA.

The tenant must reimburse the landlord for the filing fee pursuant to s 102(4)(a).
