- The tenancy of Steven Michael John Hikaiti at Unit/Flat Unit 615, 139B Greys Avenue, Auckland Central, Auckland 1010 is terminated, and possession is granted to Kāinga Ora–Homes And Communities, at 1 pm today Friday 13 March 2026.
- Steven Michael John Hikaiti must pay Kāinga Ora–Homes And Communities $384.00 immediately, being rent arrears.

Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- The landlord became aware that the tenant was not living at the property and issued a notice to the tenant on 12 December 2025 requiring the tenant to return to the property. The landlord gave evidence that the tenant did return.
- The landlord gave evidence that the tenant was arrested on 30 December 2025 and that a further notice to the tenant was issued on 3 February 2026. The landlord’s staff confirmed that the tenant had not returned to the property on the expiry of the notice. The landlord advised that its staff, who are permanently on reception at the complex of which the premises form part, have confirmed that the tenant has not returned to the premises.
- The landlord inspected the property on 11 March 2026 and provided a copy of that report. The photographic evidence supports the landlord’s belief that nobody is living at the premises.
- The landlord provided a copy of confirmation from the police that the tenant remained in custody and that his first Court appearance was scheduled for 7 May 2026.
- On the evidence before the Tribunal, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises on 19 February 2026 when its second notice expired.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
- The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice.
