Reasons
- Both parties attended the hearing, Ms Benger for the landlord in person, the tenant by phone.
- The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy.
- The tenant accepted all the landlord’s claims. The only claim that was different from the stated amount was for the painting of walls and skirtings in the 4 th bedroom. I discussed that with the landlord and the parties agreed to the Tribunal awarding compensation of $600.00 rather than the full quoted cost for re-painting the whole room of $1,196.00.
- The bond has already been paid to the landlord by consent. After the deduction of the amounts agreed to by the tenant there was a balance owing of $87.06. Result
- By consent, the tenant will pay the landlord $11,128.70. Name suppression
- The landlord did not seek name suppression. The tenant sought an order for name suppression.
- Because the tenant accepted all the landlord’s claims, this is an order that could have been made at mediation, which is a confidential process.
- I have therefore made an order for suppression of the tenant’s name.
- Had the tenant unsuccessfully defended the landlord’s claims name suppression would not have been granted.
