An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name and identifying details.
The landlord may enter the premises once on any given date between 27 May 2026 and 30 June 2026, between the hours of 8:00am and 7:00pm, for the purposes of inspecting the premises and testing for methamphetamine. The landlord must give the tenant 48 hours written notice before the inspection.
Leslie Linton must pay the landlord $28.00 immediately for the filing fee.

Reasons

The landlord attended the hearing on 26 May 2026. The tenant did not attend.
The landlord gave evidence that they have not been able to inspect the premises since March 2023, because the tenant continues to deny the landlord access.
On 10 October 2025, the landlord gave the tenant written notice of an inspection to be completed on 14 October 2025. The landlord claims that they were not able to enter the premises on this date, because the tenant refused to allow them entry and was obstructive.
The landlord seeks an order from the Tribunal, permitting them to enter the premises to complete an inspection and undertake testing for methamphetamine.
Under section 48(2)(b) and (ba) of the Residential Tenancies Act 1986 (RTA), a landlord is entitled to enter the premises for the purpose of inspecting it and testing for contaminants. The landlord must give the tenant 48 hours written notice and must not have entered the premises for these purposes within the previous 4 weeks. The inspection must also occur between the hours of 8:00am and 7:00pm. I am satisfied the landlord has tried to comply with these requirements but has not been able to access the premises, because the tenant continues to deny them entry. For these reasons, I consider this is an appropriate case in which to make an order permitting the landlord to enter the premises under section 48(2)(e) RTA.
The tenant should beware that failure to allow the landlord entry in breach of this order or more generally, in circumstances where the landlord is entitled to enter the premises under section 48(2) RTA, is an unlawful act, which may attract exemplary damages up to a maximum of $1,500.00. 1 The tenant is also at risk of potentially losing their tenancy if the landlord gives them a 14-day notice and applies to the Tribunal. Filing fee & name suppression
Because the landlord has been wholly successful with their application, I must order the tenant to reimburse the landlord the filing fee. For the same reason, I must grant the landlord’s request for name suppression.
