- Dawn Kaukau and Labana Moe owe R & B Housing Ltd $9,776.57 (“the debt”).
- Dawn Kaukau and Labana Moe must pay rent and the debt as follows: a. By making weekly payments of $840.00, being $680.00 for rent and $160.00 for the debt. b. Payments will be every Thursday, with the first payment on Thursday 30 April 2026 and continuing until the whole of the debt is cleared. c. By making one lump sum payment of $4,721.00 by Friday 1 May 2026.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenants fail to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 8A Inver Street, Glen Eden, Auckland 0602 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenants fail to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- Both parties attended the hearing today. Dawn Kaukau stated that she represented Labana Moe.
- Please note that at today’s hearing the correct parties were established and confirmed. The landlord is R & B Housing Ltd, and its representative is Richard Gore. The tenants are Dawn Kaukau and Labana Moe.
- The landlord has applied for termination of the tenancy, rent arrears and reimbursement of the filing fee. The applications for water rates and compensation for a scratch on the floor were withdrawn at today’s hearing.
- The tenants want to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- The rent record shows that as at today’s date there is $9,748.57 owing in rent arrears. This amount includes the $2,040.00 bond payment made on 13 February 2026.
- After discussion at today’s hearing I am satisfied the tenants will pay the debt within the period specified in the order and that they are unlikely to commit any further relevant breach.
- This is because I understand that WINZ will be assisting these tenants.
- I have therefore granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Filing fee reimbursement
- As well as ordering the tenants to pay the rent arrears as agreed, I am also ordering them to reimburse the filing fee to the landlord because the landlord was wholly successful with this claim against them. C ter Haar 30 April 2026
