On 30 April 2026 the Tribunal made a conditional termination order outlining a repayment and rent payment plan agreed to by the parties to avoid a termination of the tenancy. At that time there was $9,748.57 outstanding in rent arrears.

On 21 May 2026 Ms Kaukau applied for a rehearing.

On 25 May 2026 a rehearing application hearing was granted as well as a stay of proceedings as long as the tenants paid rent plus an amount towards the debt each week.

On that same day the tenant was evicted

Section 105(1) Residential Tenancies Act 1986 provides that the Tribunal has the power to order a rehearing where “a substantial wrong or miscarriage of justice has or may have occurred or is likely to occur”.

Usually the party applying for the rehearing must show that something went wrong with the Tribunal’s procedure, for example, that they did not receive notice of the hearing or they were not able to properly present their case. A rehearing may also be granted where there is new evidence that was not reasonably available at the first hearing, if it could have affected the outcome.

At today’s hearing I explained that a rehearing could not be granted given that the tenancy has already been terminated. Further it became apparent that the tenant was not denying that the rent arrears were owed.

Ms Kaukau acknowledged that a rehearing is not in fact something that she now seeks. What she wants is to get her belongings back from where the landlord has them stored.

I advised the parties that I could not make an order about this since this hearing was solely concerned with whether a rehearing should be granted.

However, the parties had a discussion and for their benefit I set out the terms of their agreement about the tenant’s belongings: If Ms Kaukau pays the landlord $750.00 which he says is the cost of storing Ms Kaukau’s belongings and getting them to the storage place, then he will bring Ms Kaukau’s property to where she is living free of charge.
